A West Virginia Marriage Amendment may appear on the 2012 statewide ballot in West Virginia as a legislatively-referred constitutional amendment. Specifically the measure proposes that, "This state and its political subdivisions shall not create or recognize a legal status for same-sex marriages to which is assigned the rights, benefits, obligations, qualities or effects of marriage."^[1]

The proposal is currently being supported by West Virginia Family Foundation and the Family Policy Council of West Virginia. The groups expect the West Virginia Legislature to consider the measure for the ballot. In the last few years, similar proposals have failed to gain the required legislative approval.^[1]

A two-thirds vote in both chambers of the West Virginia State Legislature is required to refer an amendment to the ballot.
