Across the nation, special elections are frequently conducted to fill vacancies in state legislatures. 27 states use special elections to fill legislative vacancies. In two states, Illinois and Indiana, special elections are used in limited circumstances. As of May 2012, 32 special elections (not including run-offs) have been scheduled in 13 states. Since these elections are intended to fill unexpected vacancies, more will likely be scheduled as new vacancies arise.

Tim O'Brien (D) resigned after being elected Mayor New Britain. A special election to fill his seat was held on January 10, 2012. Democrat Rick Lopes faced Republican Peter Steele and conservative independent Thomas Bozek (a former state senator).

Georgia House District 60 | |
Gloria Bromell Tinubu (D) resigned to run for South Carolina's 7th District U.S. House seat. The special election was held on February 7. Party affiliation is listed, but all candidates appear on the same ballot. Since Waites received over 50% of the vote, the March 6 run-off election was averted.[15][16][17]

Oklahoma

Oklahoma Senate District 46 | |
Andrew Rice (D) resigned effective January 15, 2011 in order to move out of state where his wife has taken a job. A special election had been scheduled for April 3, 2012 to select a replacement. However, since a primary election was not necessary, the primary election on February 14, 2012 served as the general election. The race took place in the state's new legislative districts.[28][29][30]

David Trahan (R) resigned in December 2011 to head the Sportman’s Alliance of Maine. A special election was held to replace him on February 14, 2012. The election of Democrat Chris Johnson has been seen a significant upset. [32]

Georgia House District 107, Run-off | |
Len Walker (R) resigned to take a job as pastor of church located outside his present district. The special election was held on February 7. Party affiliation is listed, but all candidates appear on the same ballot. Smith and Kirby were the top two vote-getters and proceeded to a run-off election on March 6, 2012.[44][45]

Oklahoma House District 71 | |
Daniel Sullivan (R) resigned effective November 30, 2011 in order to take a position as CEO of the Grand River Dam Authority. A special election was held on April 3, 2012 to select a replacement. The race took place in the state's new legislative districts.[70][71]

Note: This election has been invalidated. The initial count gave Dan Arthrell (D) a three-vote lead over Katie Henke (R). After a recount on April 11, Henke took the lead by one vote and the local election board certified the results. However, after the recount, two more ballots were found under a machine--both cast for Arthrell. On April 17, the Oklahoma Supreme Court put a stay on state certification until the court could review the results. On April 30, the Supreme Court ruled the election invalid, saying that the winner could not be determined with "mathematical certainty" as required by Oklahoma law. Given the approaching general election, another special election will not be scheduled to fill the seat.[72][73][74][75] | |

South Carolina House District 68 | |
| Thad Viers (R) resigned on March 21, 2012--a day before being indicted for stalking and harassment in the first degree. A special election to replace him will be held on July 24. A special primary, if necessary, will be held on June 5. Given the small gap between the special election and the general election, local leaders have called for a law blocking the special election. It is unclear if enough time remains to approve legislation before the special election.[98][99][100]

| Jane Orie (R) was convicted of 14 criminal counts on March 26, including five felony counts, relating to the use of state resources for campaign purposes. She is expected to lose her Senate seat. Two and a half years remain in her four-year Senate term.[110]

| Bill DeWeese (D) was convicted of five felonies in early February, relating to the use of legislative staff for political purposes. Deweese is expected to lose his House seat. However, he plans to appeal and run again.[111]
